Privacy Policy

We have developed a Privacy Policy to ensure clients have knowledge of, and confidence in, what information is collected and how it is used, secured and disclosed.

We have implemented an internal framework which balances the rights and interests of clients with the need to acquire and retain information necessary for the effective administration of the portable long service leave scheme.

Why is information collected and kept?

We collect and retain information from employers and workers, as required by the Construction Industry Long Service Leave Act 1987 (the Act), to determine a worker’s eligibility and entitlement to portable long service leave under the Act and to conduct other business necessary to administer the Act.

What information is kept?


Workers, Self-Employed Contractors and Working Directors

Our database includes personal information such as;

  • Name
  • Date of birth
  • Postal address
  • Telephone numbers
  • Email address
  • Industry occupation
  • Records of employment history within the construction industry (number of service days recorded, wage information and long service leave entitlements)
  • Records of contact with the Board
  • Records of financial transactions with the Board (self employed contractors and working directors)
  • Tax file number (TFN)

Employers

Our database includes information such as;

  • Business and trading names
  • Postal and business addresses
  • Australian Business Number
  • Primary business
  • Telephone numbers
  • Email address
  • Names of contact persons
  • Data submitted on Employer Returns
  • Details of all financial transactions with the Board
  • Records of contact with the Board

How long is information kept?

Records are kept indefinitely as the scheme provides for itinerant work patterns. Workers often return to the industry after leaving and may add to their previous long service leave entitlement.

Who may access records?


Workers, Self-Employed Contractors and Working Directors

Workers can access their own personal information recorded by the Board. This includes their accrued entitlements and information supplied by employers through the lodgement of employer returns.

Employers

Employers can access their own business data, historical returns data, financial transactions with the Board and their current employees’ service accrual and entitlements.

Portable Long Service Leave Staff

Authorised employees of Portable Long Service Leave may access records of employers and workers in the pursuit of their duties in administering the scheme.

Interstate Schemes

A National Reciprocal Agreement operates between portable long service schemes in all States and Territories of Australia that allows for the combining of service entitlements. Following the request and authorisation of the worker, service details can be provided to an interstate scheme.

Other parties

The Board will not provide information to third parties unless it is required by law, (e.g. mandatory reporting obligations to the Australian Taxation Office, Child Support Agency, Centrelink).

Information that is aggregated and does not identify an individual, may be released for reporting purposes (e.g. the annual report, actuarial review and Board statistical reports).

How can records be accessed?

Records may be accessed through the secure online portal, telephone, email or attendance at the Board’s office. Proof of identity will be required.

Website Privacy

Workers can log into the Board’s secure online portal to transact and update their contact details. This information is recorded in the Board’s database.

Employers can log in to the Board’s secure online portal to transact and update their contact details. This information is recorded in the Board’s database.

Sharing of information with Commonwealth Government Departments or Authorities

Organisations such as the Australian Taxation Officer, Centrelink and Child Support Agency can be provided with information about a worker or employer in accordance with their own legislative powers. Such requests must be made in writing quoting the legislative authority to seek the information.

Routine requests from the Australian Taxation Office can be actioned by the Senior Finance Officer. Routine requests from Centrelink or the Child Support Agency in relation to worker entitlements or payments can be actioned by the Finance Officer.

All other requests are to be referred to the CEO.

All responses should be in writing with the appropriate comments noted and correspondence saved in the Board’s database.

Sharing of information with Commonwealth Government Departments or Authorities

To support the Board to administer the scheme in accordance with the Act’s requirements there may be the opportunity from time to time for the Portable Long Service Leave business to share information with South Australian Government Agencies or Authorities. Any sharing of information should be done on a confidential basis and preferably with a formal Data Sharing Agreement in place to specify how and when any shared data may be used.

Any such Data Sharing will be undertaken in accordance with the South Australian Public Sector (Data Sharing) Act 2016. These Data Sharing Agreements can also be used by non-government organisations entering into data sharing agreements with government agencies or authorities.
